Abstract
In the present contribution, the authors take a stand on the current debate on the abolition of the German Lawon the amendment of first names and identification of gender identity in special cases, the so-called Transsexual Act (TSG). Starting point is the recent publication by Meyenburg, Renter-Schmidt and Schmidt (2015), who argued for the abolition of mandatory physical and mental health assessments for changing the first name. Taking a position against the proposition of a general abolition of mandatory assessments including assessments of underage applicants, the authors of the present article emphasize the need to question this proposition from a child and adolescent psychiatric perspective. Particular difficulties of diagnosis, treatment and evaluation of children and adolescents with a gender identity disorder (gender dysphoria) are addressed. Conditions particular to the assessment of minors can best be understood when taking into account developmental psychological and family dynamic aspects, something that the authors strongly recommend. In light of these considerations, it can be assumed that the abolition of mandatory assessment for patients under the age of 16 could have adverse consequences for those affected and their families
