Abstract
This essay investigates the role of self-monitoring and third-party-observation of delinquents in criminal prosecution in Germany. Judicial practice since the 18th century has shown a tendency for the reduction of negative and the expansion of positive incentives in order to motivate delinquents to disclose knowledge about indictable offfences. Recent controversial legislative projects such as expanding crown witness regulation into general criminal law attest to this development.
